General terms for end users
1.1 Introduction to terminology
In this document, the following terms are used as stated below:
“Sarita” is the welfare technology manufacturing company Sarita CareTech ApS.
“Pearl” is the personal alerting technology with intended use of supporting communication between elderly and caregivers. Pearl features are a call button, two-way call, GPS and fall detection.
“Sarita Family app” is an application for mobile phones that receives notifications from the Pearl, meant for private caregivers.
“Sarita Lighthouse” is an online platform, where institutions can setup details of the Pearl users and caregivers.
“Intended users” are
care institution staff and residents regarding care institution users, and
private caregivers and Pearl wearers regarding private users.
1.2 Types of personal data and their collection
After we receive your consent to use your personal data, Sarita CareTech will collect and save several types of personal data from you. We collect your data during registration and while you are using our products and services. We process the following information about you:
- Personal information (name, address, telephone number, email),
- Location data (GPS data about the location of the Pearl),
- Motion pattern from the Pearl.
1.3 Purpose of processing personal data
Collecting personal information allows us to provide you with the best service. Read below to learn how we use specific types of your data:
- We use personal information to administer your service account and subscriptions,
- We use location data to determine your location when the Pearl triggers alarms,
- We use location data to set up a safety zone,
- We use motion patterns for maintaining and improving the machine learning algorithm of the Pearl’s fall detection system.
1.4 Legal basis for processing personal data
Ordinary personal data such as name, address, telephone number and email are used in order to ensure that we are able to store your personal information in our database. The processing of this information is based on article 6 section 1(b) of the General Data Protection Regulation.
Your location- and motion pattern data is sensitive personal information. We handle this information solely in the interest of our users and with the aim of ensuring that our users are receiving the best possible service. Handling of this information is necessary for the performance of the Pearl’s GPS function. The processing is based on Article 9 section 2(a) of the General Data Protection Regulation.
If you don’t want the Pearl to share the location information with the intended users, you can turn off the GPS function in the Sarita Family app (private users) or Sarita Lighthouse platform (institution users). If you are not able to turn off the GPS function, please contact Sarita CareTech and we will turn it off for your device.
Sarita CareTech, is obliged to inform the Data Inspectorate of breaches and errors on our systems that have a direct influence on our and / or your personal data based on article 6 section 1(c).
1.5 Consent and withdrawal
We will only handle your personal data if we receive your consent to store it and use it. The declaration of consent can always be withdrawn by contacting Sarita CareTech, Silkeborgvej 765A, 8220 Brabrand or via email firstname.lastname@example.org. However, this does not affect the legality of the data processing that has already taken place. Withdrawal of consent therefore only takes effect from the time of withdrawal.
1.6 Storing and deleting your personal data
Your personal data will be kept as long as we have a legal duty to process them and provide you with a service. Upon canceling your subscription, we will no longer collect data on you. We have a grace period of 3 months before we delete your data regarding service and Pearl functionality, in case you wish to resubscribe for the service without data loss.
Your personal data might be used for improving the service: precision of the fall detection algorithm of the Pearl. If your data will be used for improving the service, it will be anonymized.
1.7 Your rights
You have a number of rights under the Personal Data Regulation in relation to processing information about you. If you need to exercise your rights, please contact us.
1.8 Right to see information (right of access)
You have the right to access the information we have about you. You can see the information we have about you in your profile in Sarita Lighthouse (institutions) or in Sarita webshop (private customers). If you have a problem accessing the information, please contact us (see contact information below).
1.9 Right to correction of information
If you have noticed that we have recorded incorrect personal information about you, you are entitled to have them corrected. You also have the right to have your information supplemented with additional information if this will make your personal information more complete and / or up to date.
1.10 Right to delete
You have the right to request your data to be deleted, but any ongoing service will be terminated by such request.
1.11 Right to limit the handling of personal data
You have the right to have your personal data handling restricted. The limitation of personal data use may influence which service we can provide for you, limiting the range of product functions we can offer eg.: positioning GPS data.
1.12 Right to take your data with you if special conditions are met
In some cases, you have the right to receive your personal information in a structured, commonly used and machine-readable format, and to have this personal data transferred from one data controller to another without hindrance. 1.13 If you want to complain to the Data Inspectorate
You have the right at any time to appeal to the Data Inspectorate if you believe that we do not comply with the provisions of the Data Regulation. Contact information on the Data Inspectorate can be found at www.datatilsynet.dk.

2. General terms for Website and Webshop users
Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using www.sarita.dk or www.sarita.eu (“The Sites”), operated by Sarita CareTech ApS ("us", "we", or "our"). We offer a range of services. In terms of the webshop we provide service in the form of purchasing the product. The webshop consists of prices, pictures and names of the Pearls.
The product consists of a wearable (Pearl), with built-in electronics that enable various functions (listed below). In addition, the product consists of a magnetic plate for mounting the wearable on the clothing, a charging station for charging the wearable and its associated power supply. Regarding the website we provide service in the form of giving information about the use of the product, and the features. In addition we provide customer support information.
The functions of the wearable consist of three automated features and one manual.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service or Sites. By accessing or using the Service or Sites, you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service or Sites.

2.8 Intellectual property and infringement claims
It is our policy to respond expeditiously to claims of intellectual property infringement. We will promptly process and investigate notices of alleged infringement and will take appropriate actions under applicable intellectual property laws. Notices of claimed infringement should be directed to us via email, at email@example.com.
2.9 Governing Law
These Terms shall be governed and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, the Sites, and supersede and replace any prior agreements we might have between us regarding the Service or the Sites.
Sarita CareTech received payment with VISA, VISA Electron, Mastercard and Paypal. The payment will be withdrawn at the time of purchase. The payment amount will be stated on the payment page before the purchase is completed.
All amounts stated on the webshop are in Danish kroner, and include VAT.
Sarita CareTech is using a reliable payment server, that is encrypting your card details with SSL (Secure Socket Layer) protocol. In this way, your card information cannot be read.
Sarita CareTech ships the orders on all working days. The orders placed before noon (12.00) will be shipped on the same day.
Sarita CareTech Aps operates the www.sarita.dk and www.sarita.eu websites, which provide the service mentioned in section 3.
This page is used to inform website visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service.
